Terms and conditions
The “General Terms and Conditions” apply to the following companies:

1. Scope of application
For the business relationship between Room Fox FFM GmbH (hereinafter referred to as the “Provider”) and its customers in connection with the implementation of so-called “Live Escape Games” as well as all other services related thereto (hereinafter referred to as the “Event”), the following General Terms and Conditions apply exclusively in the respective version at the time of conclusion of the contract.
2. Contract conclusion
(1) In principle, a contract is only concluded via the online booking system of the provider. The order of a period in the booking system by the customer constitutes a binding offer to conclude a contract. The contract is only considered closed upon receipt of a confirmation email from the customer.
(2) In individual cases, in agreement with the provider, a contract can also be concluded verbally, by telephone or by e-mail. The general rules of the Civil Code (§§ 145 – 157 BGB) apply here.
(3) An exchange of the contractual partner on the side of the customer is possible in principle, but requires the express consent of the provider.
3. Entrance price
(1) The admission price is determined according to the current status of the price information on the website of the provider at the time of conclusion of the contract.
(2) The entrance fee is due immediately upon conclusion of the contract and must be paid no later than 14 days before the booked period.
4. Service provision
(1) Play time is a maximum of 60 minutes for indoor events and 150 minutes for outdoor events. In the case of a shorter playing time, the customer is not entitled to a refund of all or part of the admission price.
(2) In the event of a delay of the customer, the provider is entitled to shorten the playing time in accordance with the delay. In the event of a delay of more than 20 minutes, the provider is entitled to refuse his performance. A refund of the entrance fee will not be made in this case.
5. Conduct of the event
(1) Before the start of the game, each customer must participate in an introduction by the committee.
(2) Customers are not allowed to use cameras of any kind during the game. Items that can take photos and videos can only be taken into the playrooms if they are stored in a box designated by the provider. Exceptions require the explicit consent of the provider.
(3) The games and puzzles are designed in such a way that no special application of force is necessary for the solution. Customers are expressly informed of this before the start of the game. Customers who, contrary to this note, damage or destroy the inventory of the provider by applying too much force are obliged to replace it.
6. Amendment of the contract and withdrawal
(1) There is no right of withdrawal. According to § 312g para 2 no. 9 BGB, there is no right of withdrawal for contracts for services in the area of leisure activities with a fixed date.
For bookings in FlexiFux The following cancellation conditions apply:
- Up to 72 hours before the start of the game, a cancellation or a rebooking against a voucher in the amount of the booking amount is possible.
- If the withdrawal takes place less than 72 hours before the start of the match, but no later than 09:00 on the match day, a voucher will be issued, from which a processing fee of 40 € will be deducted.
- If the withdrawal takes place after 09:00 on the match day, a withdrawal is no longer possible. The full game prize is due as a loss compensation.
For bookings in PremiumFux The following cancellation conditions apply:
- Until 72 hours before the start of the game, a cancellation or a change of booking is possible either against a voucher or a payment of the booking amount.
- If the cancellation takes place less than 72 hours before the start of the game, but no later than 09:00 on the match day, a cancellation or a rebooking against a voucher in the amount of the booking amount is possible.
- If the withdrawal takes place after 09:00 on the match day and no later than four hours before the start of the match, a voucher will be issued, from which a processing fee of 40 € will be deducted.
- If the withdrawal takes place within the last four hours before the start of the game, a withdrawal is no longer possible. The full game prize is due as a loss compensation.
If the deadline of four hours before the start of the match is before 09:00 on the match day, the four-hour period applies.
The customer is reserved the proof that the provider has not incurred any damage or a significantly lesser damage.
For clarification, the booked services are assigned to the following tariff types:
Flexi fares are: all adventures and services expressly marked as “FlexiFux” (indoor and outdoor), student and trainee fares, the puzzle table rental fee, bookings for social facilities, bookings for school classes, as well as all other fares and services not expressly named as premium fare and tied to a fixed date.
Premium fares are exclusively: all adventures and services expressly marked as “PremiumFux” (indoor and outdoor).
In order to safeguard the respective cancellation or rebooking period, it is necessary that a corresponding declaration of the customer is received by the provider in good time. The cancellation or rebooking can take place: by e-mail to the contact address specified by the provider, by leaving a message on the provider’s mailbox, or by a personal statement to an employee of the provider. A mere call attempt, a text message (e.g. messenger, SMS) or other informal contact without confirmed access to the provider is not sufficient for the deadline.
The above cancellation and cancellation regulations apply regardless of whether the booked date has already been paid at the time of the cancellation or not. Even in the case of unpaid bookings, there is no right to free cancellation or exemption from the aforementioned regulations. In these cases, the agreed game prize must first be paid in full. Subsequently, the withdrawal can take place exclusively in accordance with the above regulations.

(2) A reduction of the booked number of participants is possible under the following conditions, provided that the required minimum group size is not undershot. The relevant tariff is the tariff applicable at the time of reduction.
In the FlexiFux fare, a reduction in the number of participants is possible no later than 09:00 on the match day. In this case, a voucher equal to the difference to the originally booked number of people will be issued. There is no entitlement to payment.
In the PremiumFux fare, a reduction of the number of participants up to 72 hours before the start of the game against a refund of the already paid entrance fee in the amount of the difference is possible.
If the reduction takes place less than 72 hours before the start of the match, but no later than 09:00 on the match day, a voucher equal to the difference will be issued. A right to payment does not exist during this period.
A reduction below the minimum group size applicable for the booked adventure is not possible in any tariff.
Regardless of this, only as many people may stay at the same time per room for manoeuvre as indicated on the provider’s website for the respective room for manoeuvre.
(3) The provider reserves the right to change or cancel booked appointments at short notice, if this is necessary by changing, troubleshooting or maintaining the scope. Customers are immediately informed of this and the admission price, if any, already paid, is refunded. In addition, the provider is not obliged to reimburse the customer for useless expenses or damages caused by the change or cancellation of the booked date.
7. Conditions for participation
(1) All customers over 18 years of age are eligible to play. Minors may participate only if accompanied by a custodial adult. The accompanying person shall be responsible for the safety of the minors to be supervised. In agreement with the provider, in individual cases participants can be admitted unaccompanied who are the 12th, but not the 18th. have reached the age of one year. In no case shall the obligation of supervision be transferred to the provider.
(2) Health-impaired persons should seek medical advice before participating in game events of the provider and, in case of doubt, refrain from participating. The provider advises against participation, especially for heart disease and severe asthma. In any case, the participation of such persons shall be at their own risk. Customers with contagious diseases are excluded.
(3) Lighting installations containing flashes of light and other effects shall be installed in the rooms provided by the supplier. Players with epilepsy are therefore strongly discouraged from participating. Participation in these cases is at your own risk.
(4) Persons under the influence of alcohol, drugs or strong medicines are excluded from participation in the game event.
8. Precautionary measures
(1) In order to protect customers, the following safety instructions shall apply:
Fire, open light and smoking are strictly prohibited throughout the venue as well as in the entrance and reception area.
The designated emergency exits shall be used only in the event of fire or emergency.
In the playrooms, eating and drinking is generally prohibited. Exceptions must be agreed with the organizer before the start of the game.
The bringing of weapons, combustible or explosive substances and other dangerous articles shall be prohibited.
The bringing of own tools and other aids is prohibited.
The instructions of the game masters shall be followed in full.
(2) In the case of infringements, customers act at their own risk. In addition, the provider is entitled to exclude the customers from the further game. A refund of the entrance fee is excluded in this case.
9. Liability
(1) The provider is only liable for damages incurred insofar as this is based on a breach of an essential contractual obligation or on intentional or grossly negligent behavior by the provider, its legal representatives or vicarious agents. If a material contractual obligation is slightly negligently violated, the provider’s liability is limited to the foreseeable contractual damage. An essential contractual obligation is given for obligations, the fulfilment of which makes the proper execution of the contract only possible or on the compliance of which the customer has trusted and was allowed to trust.
(2) Any further liability for damages is excluded. Liability for culpable injury to life, body or health according to the statutory provisions remains unaffected. This also applies to mandatory liability under the Product Liability Act.
(3) The aforementioned limitation of liability also applies to possible claims of the customer against legal representatives or vicarious agents of the provider.
10. Data protection
(1) For the purpose of proper implementation and monitoring, the Provider is entitled to film the Customers during the game event by using audiovisual technology.
(2) The provider shall at no time be entitled to save the recordings and to use or evaluate them for purposes other than those referred to in paragraph 1. Exceptions require the express consent of the customers.
(3) All data transmitted to the provider is collected, stored and processed in accordance with the provisions of the Federal Data Protection Act, the Telemedia Act as well as other relevant data protection provisions for contract fulfillment and contract processing. A transfer of the data to third parties does not take place unless the customer has expressly agreed to this.
11. Set-off
The customer is only entitled to a right of set-off if his counterclaims are legally established or undisputed by the provider.
12. Choice of law and place of jurisdiction
(1) For business relations of any kind between the provider and the customer, the law of the Federal Republic of Germany applies, excluding all references to other legal systems and international contracts. The validity of UN sales law is excluded.
(2) The place of performance for any claims between the provider and the customers is the provider’s registered office (Johannisstraße 112/113, 49074 Osnabrück).
(3) The place of jurisdiction for all disputes arising from the contractual relationship between the customer and the provider shall be the registered office of the provider, provided that the customer is a merchant, a legal person under public law or a special fund under public law.
13. Severability clause
Should a provision of these terms and conditions be ineffective or become ineffective or contain a gap, this shall not affect the effectiveness of the other provisions
